Terms and Conditions of Use

  3. Eligibility. You must be at least 18 to book through the website.

  4. Intellectual property. All site content is owned or licensed by Boo’s Coastal Cart Adventures LLC. This includes logos, graphics, photos, video, text, and software. You may view and download content only for personal, non-commercial use. You may not copy, modify, distribute, display, sell, or reverse engineer any part of the site or services without prior written permission.

  5. User submissions. If you send reviews, photos, messages, or other content, you grant us a worldwide royalty-free perpetual license to use, reproduce, and display that material for marketing and operations. You represent that you own or control the rights to any material you submit.

  6. Third-party links. Our site may link to third-party sites or services. We are not responsible for their content, policies, or practices.

  7. Prohibited conduct. Do not attempt to interrupt or damage the site, bypass security, scrape data, or use the site in a way that violates law or the rights of others.

Rentals and Tours: Booking and Payment

  1. Reservation request. Submitting a request does not guarantee a booking. Bookings are confirmed only after we verify details and receive all required documents and payments.

  2. Payment. We may require full payment or a deposit to secure a date. Unpaid or incomplete bookings can be released.

  3. Security deposit and card on file. For rentals, a security deposit or an active card on file may be required to cover damage, loss, cleaning, late fees, tolls, and citations.

  4. Identification and documents. The renter and all drivers must provide a valid government-issued driver's license. We will send the required rental terms and a liability waiver. Booking remains contingent on signed documents and approval.

  5. Prices and taxes. Prices are subject to change and may not include taxes, fees, or add-ons unless stated.

Rental and Driver Requirements

  1. Vehicle. Forester 6 Plus street-legal electric golf cart.

  2. Who may rent. Renter must be at least 25 with a valid driver's license and personal auto insurance that includes liability and physical damage coverage.

  3. Who may drive? Any driver must be at least 21 with a valid driver's license and must be approved by us in writing. No unapproved drivers.

  4. Insurance. The renter and any driver agree to maintain personal auto insurance during the rental. You are financially responsible for all damage and loss while the cart is in your custody. Insurance carried by the company does not extend coverage to you unless we state otherwise in writing.

  5. Road and area rules. Operate only where legal for low-speed vehicles. Use roads posted at 35 miles per hour or lower. Obey all traffic laws, signs, and parking rules. No sidewalks or beaches. No highways or bridges were prohibited.

  6. Alcohol and drugs. Absolutely no driving under the influence of alcohol, cannabis, or any impairing substance.

  7. Safety. Seat belts for all riders. Keep hands and feet inside. No standing while moving. Do not overload the cart.

  8. Pets. Pets may ride only with prior approval and must remain under control at all times.

  9. Prohibited uses. No racing, towing, stunts, off-road use, or commercial passenger hauling unless we have approved that use in writing.

Condition, Damage, Cleaning, and Loss

  1. Inspection. You will review and sign a pre-ride condition report. Report any existing damage before departure.

  2. Responsibility for damage and loss. You are responsible for all damage, theft, loss of accessories, excessive wear, and loss of use during the rental period.

  3. Repairs. We may charge the reasonable cost to repair or the actual cash value if a total loss occurs. We may also charge for transport, administrative time, and loss of use for the time the cart is out of service.

  4. Cleaning fees. Excessive dirt, sand, spills, or pet hair may incur a cleaning fee.

  5. Citations and tolls. You are responsible for all tickets, towing, and tolls during your rental. If we have to process a citation, we may add an administrative fee.

  6. Tracking. For safety and theft protectio,n the cart may be equipped with GPS.

Pickup, Delivery, Late Returns, and Breakdowns

  1. Pickup and return times. You must return the cart at or before the agreed time.

  2. Late return. Late returns may incur hourly or daily charges.

  3. Delivery and pickup window. If we deliver or pick up, plan for an arrival window. If you are not present at the agreed time, additional fees may apply.

  4. Breakdowns. If a mechanical issue occurs, park in a safe place and contact us. We will attempt to assist. Time lost due to renter misuse is not refundable.

  5. Charging and range. The cart is provided charged at delivery. Monitor range and return with a reasonable charge level.

Tours: What to Expect and Safety

  1. Private tours. Capacity subject to cart seating and guide approval. Boo, the golden retriever, may join only when safe and space permits.

  2. Physical requirements. Guests must be able to step in and out of the cart unassisted, sit upright, and lean slightly with normal vehicle motion.

  3. Weather. Light rain tours may proceed. Severe weather may require rescheduling or a refund.

  4. Restrooms and stops. We can stop for photos and restrooms, subject to timing and route safety.

Cancellations, Rescheduling, and Refunds

  1. Rentals. Cancel at least 48 hours before the pickup time for a full refund. Cancellations inside 48 hours are non-refundable.

  2. Tours. Cancel at least 24 hours before the tour starts for a full refund. Cancellations inside 24 hours are non-refundable.

  3. Weather and safety. If we cancel for weather or safety, you may choose a refund or reschedule.

  4. No shows and late arrivals. Failure to arrive on time may reduce your experience or result in forfeiture without refund.

  5. Processing time. Refunds are returned to the original payment method.

Assumption of Risk, Waiver, and Release

  1. Risks. You understand that riding in and operating a golf cart involves risks that include collision, tipping, road hazards, weather, distracted third parties, and other factors beyond our control.

  2. Assumption of risk. You voluntarily accept all risks related to your participation.

  3. Waiver and release. To the maximum extent permitted by Florida law, you release and hold harmless Boo’s Coastal Cart Adventures LLC and its owners, employees, contractors, and agents from claims, losses, or damages arising from your participation. This includes injury to you or others and property damage. This does not apply to claims that cannot be waived under Florida law.

  4. Indemnification. You agree to defend and indemnify the company and its personnel against claims by third parties arising out of your use of the cart or participation in a tour.

Photo and Media Consent

By participating, you consent to reasonable photography and short video during rentals or tours. We may use these for marketing without additional payment. If you prefer not to be photographed, tell your guide at the start and we will respect that request.

Electronic Signatures and Notices

You agree that electronic signatures and electronic records have the same legal effect as handwritten signatures and paper records. Notices may be sent to the email you provide at booking.

  • To send service messages and, if you opt in, marketing messages. You can opt out of marketing at any time.

  • Law enforcement or regulators, when required by law or to protect safety, property, or rights.

  • Business transfers, such as a merger or asset sale, may involve the transfer of customer information to the business.

Disclaimers, Limitation of Liability, and Allocation of Risk

  1. Disclaimers. Services are provided as is and as available. We do not guarantee uninterrupted or error-free operation of the site or services.

  2. Limitation of liability. To the fullest extent allowed by Florida law, the total liability of Boo’s Coastal Cart Adventures LLC and its owners and personnel for claims arising out of or related to the site, rentals, or tours will not exceed the amount you paid to us for the specific service at issue or $100, whichever is greater.   3. Time limit to bring claims. Any claim must be brought within one year after it arises.

Dispute Resolution, Governing Law, Venue, and Class Action Waiver

  1. Good faith resolution. If a dispute arises, contact us so we can try to resolve it informally.

  2. Governing law and venue. Florida law governs these Terms without regard to conflict of law rules. The exclusive venue for any court proceeding is a state or federal court located in Pinellas County, Florida.

  3. Arbitration. At our election, any dispute that cannot be resolved informally will be submitted to binding arbitration administered by a recognized arbitration provider in Pinellas County, Florida. The arbitrator may award individual relief only.

  4. Class action and jury trial waiver. You agree to bring disputes in your capacity only. You waive any right to participate in a class or representative action, and you waive any right to a jury trial.

Termination

We may suspend or terminate access to the site or services at any time for any reason, including violation of these Terms. You may stop using the site or services at any time. Sections that by their nature should survive will survive termination.

Accessibility and Children

Entire Agreement and Severability
